The amount is a formula rather than a sum — the total cost of construction including labor and materials, or a published floor, whichever is greater. And the instrument is elective: the applicant may request to substitute the maintenance bond with a letter of credit or a cash-in-lieu payment, subject to the City Engineer’s approval. One practical point in Aspen’s favor: for work in paved areas the permittee may elect, with the City Engineer’s approval, to replace defective paved improvements itself rather than have the bond executed, and the code says plainly that the City will not replace improvements unless the contractor chooses not to.
