Any contractor awarded a Kentucky public construction contract in excess of $100,000 — by a Commonwealth state agency (KRS 45A.190) or by a local public agency operating under the local Model Procurement Code (KRS 45A.435). Both a 100% performance bond and a 100% payment bond are mandatory.
