Minnesota Manufactured Home Installer Bond
What it is & who requires it
Installers licensed by the state to set manufactured homes — the second of the two bonded residential trades, alongside the roofer, and the smallest state penal sum of the four residential licenses. Two carve-outs are worth more than the figure. First, the license carries its own plumbing exemption: a licensed manufactured home installer connecting the exterior building drain sewer outlets to the aboveground building sewer system, and the exterior water line to the aboveground water system, needs no additional licensure, bond or insurance from any unit of government for that work — the statute says so in terms and forecloses a city from asking. Second, the general residential-trades preemption applies on top, so a political subdivision may not require a separately licensed installer to hold a local license. Note that this is the installer’s bond and not the dealer’s: Minnesota bonds manufactured home dealers, limited dealers, dealer subagencies, manufacturers and installers on five different sheets at five different sums, and the four that are not the installer are dealer instruments rather than contractor instruments.
Obligee: Minnesota Department of Labor and Industry (Construction Codes and Licensing Division). Citation: Minn. Stat. § 326B.86, subd. 1(a) and (c) (bond — licensed manufactured home installers must give and maintain a bond to the state; a licensed manufactured home installer must post a bond with a penal sum of at least $2,500; the bond must comply with § 326B.0921); Minn. Stat. § 326B.805, subd. 1 (a person meeting the definition of a manufactured home installer must be licensed as a manufactured home installer by the commissioner); Minn. Stat. § 327.31, subd. 11 (definition of manufactured home installer); Minn. Filing
Filed with the commissioner on the department’s Manufactured Home Installer Surety Bond form. The statute states the sum as a floor and the mandatory form prints it fixed, in the AMOUNT box and in words and figures in the body, which is why the figure renders. Corporate surety licensed in Minnesota; no cash or deposit alternative in the chapter. Two defects on the face of the current sheet are recorded rather than smoothed over, and this form carries both that exist in the state family. Its operative condition clause recites that the principal is applying to be licensed as a manufactured home DEALER rather than as an installer — a different licensee, under a different statute, at a different sum — and its closing certification recites the electrical contractor bond subdivision as the governing authority rather than the residential trades bond section. Neither changes the printed penal sum, which matches the installer statute; but the condition clause is the part the surety answers for, so confirm the sheet with the licensing unit before executing it, and keep a copy of the confirmation.
