Filing
This page carries no figure because the instrument is not a bond-only requirement and is not a single sum. The ordinance provides that the deposit may be cash, a certificate of deposit, or a surety bond approved by the city attorney — three co-equal routes to the same legal effect, so a contractor is not obliged to buy a bond. Where a certificate of deposit is used, it must be held by a financial institution inside West Fargo or Fargo under an escrow agreement satisfactory to the city attorney. Sizing is split as well: an annual deposit is set by resolution of the board of city commissioners and excuses the special deposits, while special deposits for individual permits are determined by the city engineer case by case. Two-thirds of a deposit is released on apparent conforming completion, with the balance released at the end of the warranty period. Liability insurance is filed separately at the city’s published limit.
