Bountiful Excavation Bond

What it is & who requires it

Contractors doing any work on a dedicated Bountiful street — excavation for piping, sidewalk, curb and gutter, drive entrances or anything else. Bountiful requires an excavation permit first, requires the work to be done by a licensed contractor, and requires security of each applicant before the permit is issued to guarantee faithful performance. New or replacement concrete street improvements must be installed by a contractor holding one of two specific state classifications. Public utilities franchised by the city need file no security where the franchise documents expressly waive it.

Obligee: Bountiful City (City Engineer / Public Works; security approved by the City Attorney). Citation: Bountiful City Code § 6-9-214 (Bond — When Required, Conditions, Warranty); Ch. 6-9 Excavation in Streets and Public Properties.

Term & renewal

Term: Two years — the ordinance conditions the security on a guarantee of materials and workmanship for two years from completion of the work, reasonable wear and tear excepted. The city’s own excavation requirements ask that a blanket bond be written for one year or more from the date of issue.

Renewal: The Engineering Department administers a blanket bond covering a contractor’s street excavations for a calendar year; renew it to keep working in the right-of-way.

Filing

Filed with Bountiful City before your excavation permit is issued, in a form and from an issuer the City Attorney approves. The city code does not fix a sum: it requires an acceptable security — which it says may include a corporate surety bond, a cash bond or a letter of credit, as the City determines — in an amount the City Engineer determines, and it lets the Engineer increase or decrease that amount as the cost of the work warrants. The Engineering Department separately publishes an administrative figure for a blanket bond covering unlimited street excavations across a calendar year, but that figure is set by the department rather than by ordinance and sits alongside instruments that are not bonds at all, so the bond is listed here and the amount is confirmed when you apply. Bountiful pairs the security with liability insurance at the levels its excavation requirements specify, charges an excavation permit fee scaled to the length of the cut, and requires compaction testing on backfill. Authority: Bountiful City Code § 6-9-214.
