How contractor bonding works in Virginia

Virginia’s state contractor bond is an option, not a mandate — the requirements that bite are local

Virginia licenses contractors through the DPOR Board for Contractors (Class A, B, and C by project value), and the state contractor bond is not a flat requirement: a contractor demonstrates the net worth or equity for their license class, and only a contractor who would rather not document that net worth posts a surety bond on the Board’s form instead. Because the bond is a co-equal alternative to net worth, we carry it as a portal product, with the amount confirmed at application. Where Virginia actually requires a bond up front is at the local level — the Northern Virginia counties and the independent cities license contractors directly and set their own bond amounts.

Northern Virginia counties and independent cities set their own contractor bonds

In the Northern Virginia counties, Fairfax County requires a $10,000 bond of well-water contractors, and Prince William County requires a $10,000 home-improvement bond. Virginia’s independent cities — which belong to no county — license contractors in their own building codes: the City of Portsmouth requires a $5,000 contractor bond, as do Danville and Lynchburg, and Virginia Beach requires a $1,000 bond of sanitation-disposal contractors. Other Northern Virginia jurisdictions (Arlington, Loudoun, Fairfax electrical and sewage, and several independent cities) require their own bonds whose amount we confirm against the locality at issuance.

State right-of-way and statewide general-use products

Work in a Virginia state highway right-of-way takes a VDOT land use permit bond, sized by the district to the work. For the many Virginia jurisdictions that require a contractor, right-of-way, or land-disturbance bond but publish no fixed figure, we carry statewide general-use products — a commercial contractor license bond, street-opening / right-of-way, and land disturbance — whose amount is set by the obligee and confirmed at issuance.

Virginia surety bond FAQ

Does Virginia require a state contractor license bond?
Not as a flat mandate. Virginia licenses contractors through DPOR, and a contractor demonstrates the net worth or equity for their license class (Class A, B, or C) — or, in lieu of that, posts a surety bond on the Board’s form. The bond is a co-equal alternative to documenting net worth, so the amount depends on your situation and is confirmed at application. The separate Contractor Transaction Recovery Fund is a fund assessment, not a bond.
Which Virginia localities require their own contractor bond?
Many. Fairfax County requires a $10,000 well-water bond and Prince William County a $10,000 home-improvement bond; the independent cities of Portsmouth, Danville, and Lynchburg each require a $5,000 contractor bond, and Virginia Beach requires a $1,000 sanitation-disposal bond. Arlington, Loudoun, and several other jurisdictions require their own bonds whose amount we confirm at issuance.
What is a Virginia independent city?
Virginia is unusual in having independent cities that belong to no county — places like Portsmouth, Lynchburg, Danville, Alexandria, and Virginia Beach. They license contractors directly in their own building codes, so a contractor working there deals with the city, not a surrounding county. We handle both the independent-city bonds and the Northern Virginia county bonds.
What is a statewide general-use bond?
For Virginia jurisdictions that require a contractor, right-of-way, or land-disturbance bond but publish no fixed amount, we carry a statewide general-use product. The obligee sets the exact amount, which we confirm when you start your bond in the portal or by phone.
How fast can I get a Virginia bond?
The local contractor, well-water, home-improvement, and right-of-way bonds issue online through the portal, usually in one sitting. We confirm any obligee-set amount at issuance.
