Nonresident prime contractors performing construction, alteration, improvement or repair of real property in Wyoming, and resident prime contractors who hire a nonresident subcontractor. The security secures payment of the sales taxes that accrue on the contract. A resident prime contractor who hires a nonresident sub does not post this itself, but must register the project and withhold from the sub’s payments until the department certifies the taxes are paid. Failure to register on time carries its own penalty on the contract value.

The requirement itself reads “a surety bond or legal security”, so a bond is one accepted form rather than the only one. A separate subsection lets you provide a cash deposit instead, at a higher rate, refunded once a properly executed bond is filed or the project is satisfactorily completed. And the amount is a percentage of the payments due under the contract, or whatever the department determines, rather than a published sum. A contractor working continuously in Wyoming may instead elect a single blanket security covering all of its Wyoming contracts, which is the same instrument written larger.
