Canon City Right-of-Way Permit Bond

What it is & who requires it

Contractors excavating or working in any street, alley, sidewalk or other public right-of-way or city-owned property in Cañon City. The bond is a condition of the permit and is posted at the permittee’s own expense. Two routes exist and they suit different businesses: a per-permit bond sized to the job, or — for permittees who typically pull more than ten permits a year — a single annual bond covering all of them. Municipalities, quasi-municipal entities, ditch companies, utilities and the City itself are exempt from the bond provisions entirely.

Obligee: City of Cañon City (Public Works Director; City Attorney as to form). Citation: Cañon City Code of Ordinances, right-of-way construction and excavation permits — Performance bond (subsection H).

Term & renewal

Term: In full force and effect for two years from and after the date any excavation is made.

Renewal: Per permit, or annually if you take the blanket option.

Filing

Filed with the City before the permit issues, approved by the Public Works Director as to sufficiency and by the City Attorney as to form, and carried alongside liability insurance naming the City, its officers, employees and contractors as additional insureds. No figure appears here because the per-permit route is a percentage: the bond must equal a stated percentage above the City’s estimate of the cost of restoring the site — removal of defective material, re-compaction of subgrade and base, and construction of surface improvements — or a published floor, whichever is greater. The annual blanket route has a published figure of its own; the two are the same instrument sized two ways, which is why they are one page here. If the bond is forfeited in whole or in part, no further permit issues to you until it is reinstated or replaced. Authority: Cañon City Code, right-of-way permit performance bond.
