Three features of the Access Code keep a figure off this page. The requirement is discretionary: the department “may require” it, and the department’s regions may require one regardless of project cost. It is co-equal: the Code’s own words are “post a bond, establish an escrow account, or in some other manner provide security”, and a related provision lists a bond, an irrevocable letter of credit and certificates of deposit side by side with devices that are not security at all, such as conditions written into a zoning ordinance or a subdivision plat. And it is unsized: the security must be sufficient to cover repair or reconstruction of the access work area to a standard comparable with pre-construction conditions, as the department determines.
