Denver Sewer Layer License Bond

What it is & who requires it

Anyone in the business of opening, uncovering or laying private sewers or building sewers in Denver. This is the small, private-side companion to the city’s public sewer contractor license: that one covers storm and sanitary sewers in the public way and carries a much larger bond, while this one covers the building sewer running from a property to the city main. One exemption matters: a plumber duly licensed as such by the State of Colorado is not required to hold this license. Trade licenses or certificates are still required to cover work performed on any building or private sewer.

Obligee: City and County of Denver (Department of Licensing and Consumer Protection). Citation: Denver Revised Municipal Code § 56-68 (Bond prerequisite to issuance); § 56-66 (Required); § 32-113 (Sewer layers); Code 1950 §§ 338.2, 338.5; Ord. No. 78-87 § 13, 2-9-87; Ord. No. 39-20 § 233, 2-3-20; Ord. No. 1003-25 § 33, 7-28-25.

Term & renewal

Term: Continuous. The bond stays in full force and effect until the surety files a ninety day notice of its desire to be relieved of liability, and cancellation does not discharge liability already accrued or accruing before that period expires.

Renewal: Continuous rather than annually re-executed, though the license itself is renewed and a fee paid each year.

Filing

Filed with the City with your sewer layer license application. Denver prints the whole bond form inside the ordinance, which is unusually explicit about the instrument: the surety must be a company duly qualified under the laws of the State of Colorado as a surety company, and the obligation runs to the City and County of Denver as a municipal corporation. The three conditions are worth reading before you sign — compliance with the city’s sewer rules and payment of all fees lawfully assessed; indemnifying the city against claims, damages, losses, suits and judgments arising from the opening or laying of any private or building sewer or its maintenance; and satisfying tort judgments obtained by reason of negligence in that work. Authority: D.R.M.C. § 56-68.
