Frisco Excavation Permit Bond
What it is & who requires it
Anyone excavating in a street, alley, sidewalk or other public place in Frisco. The permit will not issue until the fee and the bond are both in hand. Frisco is unusually specific about what the bond answers for: you must restore any excavation in the public right-of-way to an acceptable temporary condition within twenty-four hours of commencing and complete the permanent repair within ten days, and no asphalt or concrete cut may be left without a permanent repair after 31 October — if it is, the Town is entitled to payment under the bond on demand and without further notice. A separate Frisco bond applies if you connect to the town water distribution system: anyone other than the Water Superintendent’s own people must post a performance bond running to the town in a penal sum of not less than the total cost of the work, executed by a qualified corporate surety, and it answers for unpaid labor and materials as well as damage to the system.

Posted with the Public Works Office Manager before the excavation permit issues, together with a certificate of insurance. No figure appears here because Frisco publishes a rate rather than a sum: the bond is computed per square yard of disturbed surface — one rate in dirt and gravel, a higher one in asphalt, higher again in concrete — with a published floor beneath the whole schedule, so a small utility cut and a street-wide reconstruction are bonded at very different amounts under the same rule. During the two-year warranty period the Public Works Director may require remedial work on fifteen days’ notice mailed to the address shown on the bond, and if it is not done the Town may do it and claim.
