Rio Rancho Right-of-Way Use Permit Bond

What it is & who requires it

Contractors working in the Rio Rancho right-of-way or a public utility easement. The city requires a current Rio Rancho business license, the bond, and insurance on file before it will approve a right-of-way permit, and it is strict about who holds them: each contractor must obtain their own permit with their own licensing, insurance and bonding, and no subcontractor may work under another entity’s permit. The city also reserves the right to limit how many permits one contractor holds at a time, so that restoration keeps pace with the digging. Work for a city capital improvement project is outside this requirement — the ordinance says the bond is not in addition to the bonding and insurance that project already carries.

Obligee: City of Rio Rancho (Development Services Department, Engineering Development Division). Citation: Rio Rancho Municipal Code ch. 96 (Use of Public Right-of-Way), § 96 (H) (bond and insurance prior to permit approval); § 96 (F)–(G) (permittee responsibilities, utility location); § 96 (J) (performance and removal bond for facility occupants — a separate instrument); City of Rio Rancho DSD ROW Permit Application DS-ENG-03(E).

Term & renewal

Term: Held until the city determines the work is successfully completed, at which point the bond is returned to the permittee. The ordinance lets it be written for a single event, for a specific duration, or as an evergreen filing.

Renewal: Kept on file with the City alongside your business license and insurance; an evergreen filing carries across permits rather than being replaced job by job.

Filing

Filed with the Rio Rancho Development Services Department before the right-of-way permit is approved, with the permit itself submitted at least seven working days before work starts. What the bond secures is successful completion of the installation if you fail to comply with the permit’s plans and specifications, and the city may also draw on it to correct damage your work causes to existing infrastructure. Two things keep a figure off this page. The ordinance expressly reserves the right to request additional bonding where the amount of the work or the risk exceeds what the bond can carry, so the published number is a starting point rather than a ceiling. And the City’s own right-of-way permit page states the requirement as a minimum rather than as a set sum. There is no published bond form to settle the difference, so the amount is confirmed with the city when your permit is written. Note that a separate performance and removal bond applies to occupants who leave facilities in the right-of-way, which is a different instrument with a different principal. Authority: Rio Rancho Municipal Code ch. 96.
