Contractors and utility crews performing any construction activity, excavation or traffic control within Utah state highway right-of-way under a UDOT encroachment permit. Utah law prohibits digging in the right-of-way, or placing an approach road, driveway, pole, pipeline, conduit, sewer, ditch, culvert or sign there, without a permit, and the Department issues encroachment permits only to bonded contractors. You choose the form: an individual bond covering one encroachment permit, or — if you take out permits routinely — a single statewide bond that satisfies the bonding requirement in every UDOT region in place of posting a separate bond for each permit. The bond guarantees you complete the permitted work, restore the right-of-way and any roads, ditches, bridges and culverts you affected, and warranty the work. Political subdivisions and entities exempted from bonding by law are excused where they do the work themselves; their contractors are not.

Term & renewal
Term: Three years — the bond runs for three years from the start of the work or two years from its end, whichever gives the longer coverage, so that it warranties the restored right-of-way against latent defects. The statewide form is continuous and stays in force for any work permitted before it is terminated, on ninety days’ written notice to the Department.
Renewal: Per permit on the individual form; continuous on the statewide form, which covers permitted work in every UDOT region until it is cancelled.
Filing
Provided to the UDOT region permit office issuing your encroachment permit, on the Department’s own bond form, before the permit is released. Utah publishes two versions of the same requirement — an individual form covering a single encroachment, and a statewide form you may elect in place of posting multiple one-time-use bonds — and the same rule governs both, which is why they are represented here as one bond. The figures in the rule are expressly minimums rather than set sums: the region permits officer determines the amount from the scope of the work being performed, the Department may require more where the scope carries more risk, and on the individual bond the officer may also approve a lesser amount. That is why the bond is listed and the exact amount is confirmed when you apply. The Department may additionally call for an inspection bond to secure payment for its field review and inspection, and a certificate of liability insurance is filed alongside the bond.
